For the purpose of these Terms and Conditions, The term "we", "us", "our" used anywhere on this page shall mean The Tennis Theory Biomechanics & Analytics. "you", “your”, "user", “visitor” shall mean any natural or legal person who is visiting our website and/or agreed to purchase from us.
Your use of the website and/or purchase from us are governed by following Terms and Conditions:
- The content of the pages of this website is subject to change without notice.
- Neither we nor any third parties provide any warranty or guarantee as to the accuracy,
timeliness, performance, completeness or suitability of the information and materials found
or offered on this website for any particular purpose. You acknowledge that such
information and materials may contain inaccuracies or errors and we expressly exclude
liability for any such inaccuracies or errors to the fullest extent permitted by law.
- Your use of any information or materials on our website and/or product pages is entirely
at your own risk, for which we shall not be liable. It shall be your own responsibility to
ensure that any products, services or information available through our website and/or
product pages meet your specific requirements.
- Our website contains material which is owned by or licensed to us. This material includes,

Tennis Theory Biomechanics & Analytics’s prior written consent.

Any dispute arising out of use of our website and/or purchase with us and/or any
engagement with us is subject to the laws of India.
- We, shall be under no liability whatsoever in respect of any loss or damage arising directly
or indirectly out of the decline of authorization for any Transaction, on Account of the
Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank
from time to time
- We know how frustrating it can be when you feel let down or that you’re not being listened
to. We understand that this is sometimes the case for our customers, and we respect their
need to express themselves.
- However, we expect customers to always act with courtesy and respect when interacting
with our staff. We have zero tolerance on violence, abuse and discriminatory behavior
directed at our staff, at those working on our behalf, or at fellow customers.
- We won't tolerate aggressive or abusive behaviour directed towards our staff or other
customers during any form of interaction, i.e., face to face, on social media, online chat,
over the phone, via email, or in any other form of communication.
This includes:
- Any form of physical, hostile, or abusive behaviour.
- Use of inappropriate language, verbal or written, which may cause a member of staff or
fellow customer to feel scared, abused, intimidated, threatened or offended. This could be:
- Creating a hostile, degrading or offensive interaction
- Using a bullying tone or language
- Inappropriate religious, cultural, or racial comments or insults; including racial
stereotypes and judgements based on accent, such as asking to speak to someone
who is ‘from this country’
- Bi-phobic, homophobic, or transphobic comments – sexist or other derogatory
remarks
- Discrimination against any other protected characteristics as defined by the Law.
Our Policy in Action
- Experienced employees know how to handle contact with angry customers, giving them
the time and opportunity to share any frustrations at the company’s processes and
operations and meeting anger with understanding and patience. But if the anger is actively
directed at our staff and language becomes abusive and/or personal, the situation becomes
unacceptable.
- Our staff will politely and respectfully ask customers to stop using this kind of language or
behaving in this way, in line with this Customer Conduct Policy.
- If the behavior then continues, our staff have the option to request offenders immediately
vacate our sports centre, stop the conversation, or remove themselves from the situation.
- We may also, at our sole discretion, ban the individual or refer specific cases or repeat
offenders to the authorities.
- Any physical attack or violence will not be tolerated and will always be reported.
Liability Waiver
THIS IS A RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY
AGREEMENT for “THE TENNIS THEORY BIOMECHANICS & ANALYTICS” IN CONSIDERATION
of being permitted to participate in any way in the EVENT(S), for him/herself, his/her personal
representatives, heirs, and next of kin:
- HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE “THE TENNIS
THEORY BIOMECHANICS & ANALYTICS” and all of their directors, officers, agents,
volunteers and employees or representatives, FROM ALL LIABILITY the user, his/her personal
representatives, assigns, heirs and next of kin FOR ANY AND ALL LOSS OR DAMAGE, AND
ANY CLAIM OR DEMANDS THEREFORE ON ACCOUNT OF INJURY AND/OR EXPOSURE
TO INFECTIOUS SYNDROMES OR DISEASES TO THE PERSON OR PROPERTY OR
RESULTING IN ILLNESS AND/OR DEATH OF THE USER ARISING OUT OF OR RELATED
TO THE EVENT(S) ORGANIZED BY US.’
- HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS and each of them
FROM ANY LOSS, LIABILITY, DAMAGE, OR COST they may incur arising out of or related
to the participating in the programs organized by us.
- HEREBY acknowledges that Tennis MAY BE DANGEROUS and you ASSUME FULL
RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, EXPOSURE, DEATH OR
PROPERTY DAMAGE arising out of or related to the participation of the activities organized by
us.
- You agree that we shall have the right to the Use of any Audio, Visual and Literary tools to impart
training and any such Audio & Visual recording obtained during the training process by us shall be
the proprietary material of us alone. You acknowledge and agree that you shall not be entitled to
receive any compensation whatsoever in connection with the exercise of creation and use of the
aforementioned Audio, Visual and Literary Material.
- You represent that you are physically and mentally capable of participating and have no known
health restrictions, you are in good physical condition and that you will only engage in activities in
which you are physically fit to participate.
PARENT OR LEGAL GUARDIAN ACKNOWLEDGEMENT (IF UNDER THE AGE OF 18)
- You represent and warrant that you are the parent or legal guardian of, the individual who is
participating (“Minor”) and that you have received, read, and understood the above mentioned
Terms & Conditions. You fully consent with your freewill to and voluntarily execute on on Minor’s
behalf. You acknowledge and agree that all representations, consents, agreements, grants, waivers,
authorizations, indemnifications and releases herein shall be regarded as made by you on behalf of
the Minor and shall be binding on you and the Minor.
- Furthermore, for the Minor in the Event, you hereby agree to be bound by and to perform all of the
terms and conditions. (including, without limitation, the provisions regarding release of all claims),
as such terms and conditions may relate to the participation of the Minor in the Event, if any.
Medical Information
- If you suffer an injury on our premises, it is your responsibility to report it to a
member of staff immediately. We will not accept liability for any injuries incurred
during play or visiting our sports facility.
- It is your responsibility to inform us of any relevant medical condition or disability
when making your booking. Players must also notify us of any change or
deterioration of any such medical condition or disability. We will keep this
information confidential and handle such issues with discretion.
- It is our policy to include all individuals within the scheduled programmes
wherever possible, but we reserve the right to refuse the booking if we are unable
to accommodate the requirements of any individual.
Medical Release

I(Participant) hereby consent to the rendering of emergency first aid or medical treatment
deemed reasonably necessary for Participant by the Released Parties at the time of injury
or illness in their sole discretion. I further understand that I will be responsible for payment
for any such medical treatment if required.
- I am fully aware of the risks involved with entering the Tennis Court premises, as well as
any transportation and/or (collectively, the “Facilities”) during the COVID-19 pandemic
(or with respect to any related or similar infection, which together are herein referred to as
“COVID-19”. I am entering into this waiver knowingly and on my own behalf.
- I acknowledge that the risks involved with entering the Facilities and being in the presence
of other people during the COVID-19 pandemic include, but are not limited to, contracting
COVID-19, respiratory failure, death, and transmitting COVID-19 to family or household
members and others who may also suffer these effects.
- I further understand that compliance with the COVID-19 protocols will not eliminate these
risks, even with social distancing and other safety measures in place at the Facilities.
Notwithstanding the foregoing, I elect to voluntarily have my student participate in entering
the Facilities with full knowledge that doing so may be hazardous to my health and those
with whom I may come into contact.
- Concussion Waiver: The Tennis Theory Biomechanics & Analytics and any of its affiliates,
members, Teachers, coaches, agents, employees, officers, directors, contractors, sponsors,
and other representatives, successors and assigns (collectively, the “Released Parties”) are
not assuming any responsibility of any kind.
- While our events involve minimal contact and the risk for concussions in our programs is
low, we ask that you read and acknowledge that you understand our concussion safety
policy below.
- What is a Concussion? A concussion is a type of traumatic brain injury—or TBI—caused
by a bump, blow, or jolt to the head or by a hit to the body that causes the head and brain
to move rapidly back and forth. This sudden movement can cause the brain to bounce
around or twist in the skull, creating chemical changes in the brain and sometimes
stretching and damaging brain cells.
- An athlete/Participant who is suspected of sustaining a concussion or head injury will be
removed from the practice or game immediately and will not be allowed to return to play
without written clearance from a licensed health care provider. The player should not be
left alone, and the parent/guardian will be notified to follow up accordingly.
- Participant assumes full risk and responsibility for any death, disability, or bodily injury
that Participant may suffer, or damage to property that may be caused, arising from any
cause whatsoever, or any death, disability, or bodily injury or property damage to another
person arising from Participant’s participation in the Event. Participant forever discharges
and waives any claim or legal action of any nature, known, or unknown, in law or in equity,
which Participant or Participant’s heirs or legal representatives shall or have made in that
regard.
- The above-mentioned participant also understands that there is a risk of loss, theft, and
damage to any personal belongings, personal equipment, and other property that Participant
brings onto the premises, and the Participant does not and will not hold the Released Parties
responsible in any way.
- In consideration of the acceptance of participation in the Event/program, Participant,
directly and on behalf of Participant’s heirs and legal representatives, releases and forever
discharges the Released Parties from any and all claims, damages, losses, or injuries that
Participant may suffer or sustain, by negligence or otherwise, arising out of or relating to
Participant’s participation in the Event, including with regard to any travel to and from the
event. All such claims, whether known or unknown, are hereby waived and released and
Participant covenants not to sue thereon.
- BY REGISTERING, YOU ACKNOWLEDGE THAT YOU HAVE READ AND FULLY
UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT YOU
ARE VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING
THE RIGHT TO SUE THE COMPANY, WITHOUT ANY INDUCEMENT,
ASSURANCE, OR GUARANTEE BEING MADE. YOU INTEND YOUR SIGNATURE
TO BE THE REQUIRED EVIDENCE OF YOUR ASSENT TO COMPLETELY AND
UNCONDITIONALLY RELEASE ALL LIABILITY TO THE GREATEST EXTENT
ALLOWED BY LAW.
- You also agree to allow photo, video, or film likeness to be used for any legitimate purpose
by the activity holders, producers, sponsors, organizers and assigns. The Accident Waiver
and Release of Liability Form shall be construed broadly to provide a release and waiver
to the maximum extent permissible under applicable law. The Richwoods Academy, its
Trustees, directors, officers, and all its employees, acting officially or otherwise are hereby
released from any and all claims, demands, actions, or causes of action on account of any
injury to the child that may occur. This release binds your heirs, executors, administrators,
and/or assigns.
